To Be An Executor Or Not To Be An Executor
Ian Hull will look at today's estate executor both from a legal and practical standpoint.
This session will include a review of the complex role of an executor including issues of family dynamics and multi-generational families and the impact of the movement away from the nuclear family.
Considerations will be given to changes affecting the risks of executors such as increasing wealth, investment management expectations and the ongoing concerns of litigation that can arise when an executor is charged with the fiduciary duty of managing an estate.
This session will also include a discussion on the expectations of accountability from a communications standpoint with beneficiaries and will consider the fiduciary requirements of a trustee during the performance of the trust.
Trustee negligence will be generally reviewed and solutions to the ongoing and rising risk of acting as an executor will be considered.
